Wrongful Death Laws in Maryland
Every state has its own laws regarding wrongful death claims, and Maryland is no different. In Maryland, wrongful death claims are divided into two categories.
These categories are:
- Survival actions, which are meant to compensate the decedent’s estate for its losses. These losses would consist of funeral and burial expenses, medical costs incurred that led to the death, and any pain and suffering the decedent experienced prior to passing.
- Wrongful death actions, which are filed on behalf of the survivors, such as the surviving spouse, children, or parents. This compensation generally covers both the economic losses, such as the lost income the decedent would have provided had he or she lived, and non-economic losses, such as the loss of companionship, love, affection, instruction, and emotional support.
The surviving spouse, children, or parents of the decedent are considered primary beneficiaries who may file both a survival action and a wrongful death action. If they are not available, secondary beneficiaries such as siblings, cousins, and other relatives may file. The state of Maryland caps non-economic damages at $2 million. The statute of limitations on filing these actions is three years from the date of the decedent’s death.
